Content submission agreement

AlbaMaito is pleased that you are willing to share your content review or photo with us. We happily like to feature them (as here we refer to them generally as content) on our website and social media.

Following is all your right and warrant consent that you present while sharing any forms of media/content with us. The goal of preparing this policy is to make sure that we are receiving and broadcasting the right feedback to our valued customers, our customer know their right, and our platform is secure and safe-to-use for everybody.

• AlbaMarito is a public forum and your content and other personal information, when you choose to share during a review, will be available to all other users of AlbaMarito.com, and potentially third-Party Sites;
• You are sharing content that you are the sole author and owner of the intellectual property and other rights. Alternatively, you have the necessary licenses, rights, consents, and of course the required permissions to share, use and provide a non-exclusive license to AlbaMarito.com. 
• You should know that by sharing content, you are giving AlbaMarito.com the to use all intellectual property and other rights thereto to enable inclusion and use of the content in the manner contemplated by us.
• You understand that your Content may be utilized and distributed by us for marketing materials. We may use your shared content for commercial use such as email marketing, social channels, store materials, and promotion. 
• You shall comply with the Federal Trade Commission’s Guides on the Use of Endorsements and Testimonials in Advertising. This means that you should receive compensation in any form or any other incentive, points, or similar in exchange for posting content on our sites or channels, then you must disclose, clearly and conspicuously in your posting. What does it mean? It means if you posted something to praise our product in exchange for an intensive or gift, be honest and tell other customers. We want the most honest reviews, and honest feedback to improve and to make our customers happy.
• When you are sharing a review, photo, or any content, you are waving the "moral rights" and other non-assignable rights that you may have. As a result, you do not require that any personally identifying information be used in connection with the Content that you submit, or any derivative works of or upgrades or updates thereto. To be such:
• All Content that you post is accurate, honest, and is in the manner of feedback
• Customers to leave, and share content must be older than 15 years old. 
• If a minor wants to share content with AlbaMarito, then you have documented, or verifiable the consent of your parent/legal guardian to use, and also you agree that to use of the content you supply does not violate these Terms of Use or the Children’s Online Privacy Protection Act of 1998, and will not cause any form of harm and injury to any person or entity.

We appreciate your review; however, your review/content/media must follow according to the following warrant:

• It is not false, stolen content, inaccurate, and misleading
• It does not harm or offend minors
• The content is not violating any copyright, patent, trademark, trade secret, or other proprietary rights 
• Does not violate any obligations you may have concerning such content under any law or contractual or fiduciary relationships - By sharing the content, you are not violating any agreement that you may have with a person or organization.
• Your content is not inside information, proprietary and confidential information
• Please make sure that by sharing any content on AlbaMarito.com or its social media, you are not violating any law, statute, ordinance, or regulation 
• Your content is not illegal, detrimental, defamatory, trolling, bullying, slanderous, vulgar, obscene, invasive of privacy, hateful, racially or religiously prejudiced or profane, abusive, tortious, intimidating, or intentionally disturbing to any individual, partnership, or corporation.
• By sharing your content, you comply in all respects with these Terms of Use, our Privacy Policy, and all guidelines and rules.
• Is not a form of phishing and does not contain unrequested or unauthorized advertising, or promotional materials, and does not interpret as junk mail, spam, chain letters, or any other form of solicitation.
• The content does not contain any potentially damaging computer programs or files.

We at AlbaMarito do not endorse or sanction any content or any opinion. You are free to share your feedback, recommendation, or advice according to the product you received. We disclaim all liability concerning the Content posted by third parties.

 If your content includes proposals to improve in any form, either product or operation by AlbaMarito, and share on any platforms running with AlbaMaritom then you should know that such content is not confidential or proprietary and we have the right of no obligation of confidentiality, express or implied. You also may consider that we may have something similar to that idea already under consideration or development. Yet we value ideas, please do not expect to be compensated of any kind in return, unless you are otherwise notified by AlbaMarito in writing.

Last but not least, for any content that you may submit, you grant us a global, unchanging, non-exclusive, conclusive, royalty-free, transferable right and license to use. We may reproduce, express, distribute, share, copy, modify, commercialize, edit, adapt, publish, translate, publicly portray, publicly execute, use, and create derivative works from your content. Such commercialization would happen without compensation to you. This includes, but is not limited to, sharing your Content, including your ratings and reviews, with third-party brands whose products we sell. This license will prevail the termination of these Terms of Use and your use of AlbaMarito.
